Thinking about the relationship between the UPF and its member worlds, it seems to me that the UPF would be less likely to have capitol punishment then its most conservative member planets. Sort of a reverse of New York state and the federal government: New York, despite having capitol punishment on the books doesn't execute anyone where as the federal government does. In the Frontier capitol punishment is far more likely an occurance carried out by a planetary government then the UPF. Even in the case of sathar spies and traitors, because even at the founding of the UPF there would have been some trade offs in the treaty for the sake of agreement and its more likely that capitol punishment on the federal level would not have been pushed for.

This of course sets up a situation where it might be preferable to have a criminal tried by one authority over another. A killer's lawyer fights to get the venue of a trail changed to a federal court over a colony court just to save his client's life, knowing that if they go to trial on Pale his client could get the deathpenalty.

I agree with this point of view.  I do see military courts having the ability to impose capital punishment in times of war and the UPF taking advantage of this during SW1 and SW2 and the First Common Muster when they spaced the leader of the pirates.

Actually the First Common Muster predated the formation of the UPF. I think that Hatzk Naar's execution was classic "Frontier Justice" as in the wild west frontier justice. On the authority of the leaders of the muster he was spaced. But good point he is the only formally identified executed criminal in the setting that I am aware of. (there is a piece of trivia for you)

Military Tribunals in times of war certainly seem reasonable cases for capitol punishment.
